Formal Approaches: Due Process Complaint

”Image of a screen with a photograph of a mom and dad with their young son between them. The parents are looking at paperwork. A series of tabs are at the bottom of the screen with the tab for Due Process Complaint highlighted.

Text reads: Title: Due Process Complaint. A due process complaint is a letter filed by the parents or the school district regarding issues related to a child’s identification, evaluation, placement, or provision of Free and Appropriate Public Placement (FAPE). The complaint must be filed within 2 years of the issue in dispute.”

Filing a due process complaint is the first step in the process that may lead to a due process hearing.
