Click on each circle to review the major procedural steps followed in most states. During the hearing, the judge will seek to determine if criteria for incapacitation has been met and to what degree. If the court makes the decision that full or partial guardianship is required, the judge will appoint a guardian of the person and/or the property. Note: The same person can be both guardian and conservator or there may be a different person for each responsibility. Depending on the circumstances, the court can order a guardianship or conservatorship to be full, limited, partial, or temporary. A guardianship or conservatorship defined as limited or partial restricts the powers of the guardian or conservator and allows the individual to retain more of his/her own legal rights.
