The Impact Aid for Children with Severe Disabilities Program grants funds to eligible local education agencies for providing special education and related services to eligible military dependent children with severe disabilities. The program was established to make payments, when appropriated, to eligible LEAs for costs incurred in providing a free appropriate public education to military children with severe disabilities.
Eligibility and application
The Impact Aid for Children with Severe Disabilities Program is available to LEAs that have at least two military dependent children with severe disabilities who meet certain special education cost criteria. Payment is made on behalf of children whose individual cost of education and related services exceeds either of the following:
- Five times the national or state average per pupil expenditure (whichever is lower) for a special education program that is located outside of the boundaries of the school district of the LEA and pays for the FAPE of the student
- Three times the state average per pupil expenditure for a special education program offered by the LEA or within the boundaries of the school district served by the LEA
Data submitted by LEAs to the Department of Education on applications for the Federal Impact Aid Program determine an LEA's initial eligibility for the program. Local education agencies certifying to the Department of Education they provide special education or related services to at least two military dependent children with disabilities will be invited by the Deputy Assistant Secretary of Defense for Military Community and Family Policy to apply for impact aid funding for children with severe disabilities. Contacted LEAs should review the application, guidance and their special education costs for at least two military dependent children with severe disabilities to determine their eligibility to receive funds.
The following Department of Defense forms serve as applications for Impact Aid for Children with Severe Disabilities Program and should be submitted only if the LEA applied and was approved to receive Federal Impact Aid under Section 8003 of the Elementary and Secondary Education Act of 1965, as amended (20 U.S.C. 7703):
Applications must be submitted electronically and the signature sheet must be faxed to 703- 588-5330. The DoD Impact Aid for Children with Severe Disabilities Program manager administers the Supplement to Impact Aid programs and assists eligible LEAs with their applications.
The program is certified yearly with information provided by LEAs to the Department of Education on the Federal Impact Aid Form. DoD works with LEAs and the Department of Education to clarify or resolve any funding or disbursement eligibility issues.
Funding and payment
Funding awards and levels vary according to the number of eligible LEAs and their military dependent students, and the amount of funding appropriated by Congress.
The Supplement to Impact Aid programs are subject to yearly appropriations by Congress. For fiscal year 2013, Congress appropriated $4.6 million for the Children with Severe Disabilities Program.
Use of funds
As with the Department of Education Impact Aid Program, the Impact Aid for Children with Severe Disabilities Program payments are reimbursable in nature; therefore, LEAs may use the payments without restriction. No statutory requirements mandate school districts report on the use of these funds.
